Terms of Service

YachtSphere · last updated 8 September 2026

These Terms of Service ("Terms") govern your access to and use of YachtSphere ("YachtSphere", "the service", "we", "us"), a yacht-management platform operated by JTN Marine. By creating an account, redeeming an access code, or using the service, you agree to these Terms. If you use the service on behalf of a company, you confirm you are authorized to accept these Terms for that company.

1. The service

YachtSphere is a subscription software service for managing yacht operations — expenses, maintenance, charters, crew, documents, messaging, live tracking and reports. We may add, change or remove features to improve the service.

2. Accounts and eligibility

The service is for business use by yacht owners, managers, captains and crew, and you must be at least 18 years old to hold an account. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure (we recommend enabling two-factor authentication), and for all activity under your account. A company administrator (Manager) is responsible for the people they invite into their workspace and for having the right to enter any personal data about them.

3. Free trial

New company workspaces may start with a free trial (currently 7 days). At the end of the trial the workspace must be activated on a paid subscription to keep access; otherwise it may be suspended.

4. Subscriptions, billing and taxes

YachtSphere is a business (B2B) subscription. Fees are billed outside the app — there is no in-app purchase; you simply sign in. We (or our authorized reseller) invoice the subscribing company directly, and the company agrees to pay the fees quoted for its plan, plus any applicable taxes. Unless stated otherwise, fees are non-refundable and paid in advance for each billing period. If payment is not received, we may suspend or downgrade the workspace after reasonable notice. We may change pricing with advance notice effective from the next billing period.

5. Your data and ownership

The content your company puts into the service (its "Customer Data") remains yours. You grant us the limited right to host and process it only to provide the service. We handle personal data as described in our Privacy Policy. You can export your data at any time (CSV, PDF, Excel). You are responsible for the lawfulness of the data you enter, including having any consents needed to store crew and third-party information.

6. Acceptable use

You agree not to:

  • use the service for anything unlawful, or to store unlawful content;
  • attempt to access other companies' workspaces or data;
  • probe, scan, or circumvent the security of the service, or disrupt it;
  • reverse-engineer, copy or resell the software except as allowed by law;
  • upload malware or use the service to send spam.

7. Intellectual property

The YachtSphere software, design and trademarks are owned by us. We grant your company a non-exclusive, non-transferable right to use the service during your subscription. These Terms do not transfer any ownership of the software to you.

8. Third-party services

The service relies on third parties to provide certain features (for example Google's Gemini to read scanned receipts, Brevo for email, and map/weather providers). Your use of those features may be subject to those providers' own terms, and we are not responsible for third-party services.

9. Availability

We work to keep the service available and backed up daily, but it is provided without a guaranteed uptime or service-level commitment unless separately agreed in writing. We may perform maintenance and may occasionally need to suspend the service.

10. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be error-free or uninterrupted, and you are responsible for keeping your own records for legal, tax and accounting purposes.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability arising out of or relating to the service will not exceed the amount you paid us for the service in the 12 months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your Customer Data, your use of the service, or your breach of these Terms.

13. Term and termination

These Terms apply while you use the service. You may stop using it and ask us to close your workspace at any time. We may suspend or terminate access for non-payment or breach of these Terms. After termination, we will make your data available for export for a reasonable period and then delete it, after which backups age out on their normal cycle.

14. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, to the extent permitted by law.

15. Changes to these Terms

We may update these Terms. Material changes will be reflected by the "last updated" date above, and continued use of the service after a change means you accept the updated Terms.
